MyPermissions-利用規約
アプリ・パーミッションズ・コントロール・サービスである My Permissions(「本サービス」といいます。詳細は下記の通りです。)へようこそ。本サービスは、Online Permissions Technologies Ltd.(「当社」といいます。)によって、所有・運営されています。
本サービスをインストールしアクセスすることにより、又は本サービスを他の方法によって使用することにより、お客様はこの規約(「本利用規約」といいます。)に同意されたものとします。
本利用規約は、お客様によるMy Permissionsのアプリ、ブラウザー・アドオン、ウェブサイト、その他当社が将来において追加する全てのプラットフォームの使用を対象とするものです。
お客様が本利用規約に同意されない場合、お客様は本サービスをインストールしたりアクセスしたりすることができず、その他のいかなる方法によっても本サービスを使用することはできません。
本サービスについて
本サービスは、ソフトウェアに基礎を置くものであり、お客様は、お客様のデバイスやお客様の個人情報にアクセスする第三者のソフトウェアやサービスに対して与えたお客様の承認を管理し、コントロールすることができるようになります。本サービスは、お客様に代わって当該承認をスキャンし、承認を取消すための簡易な方法を提供し、アプリを完全に削除し、お客様の個人情報にアクセスするアプリについての警告を表示し又はeメールを通じてお客様に警告をお送りし、当該アプリが信頼できるものかどうかを表示します。
アプリの信頼度及び評判についての指標
当社は、一元的なアプリの信頼度スコアを作成するために、100万を超えるアプリを分析しました。当該スコアは多様なデータ要因によって構成され、異なるアプリの信頼度レベルを比較します。また、当社は、一元的なアプリの評判スコアを作成するために、お客様の信頼度及び満足度に関する指標(アプリの有効期間、アンインストールの有無、明確な信頼の有無等)を収集します。
権利及びライセンスの付与
当社は、お客様に対し、本利用規約に従い、お客様の個人的、非商業的かつ私的な使用でありかつお客様のアプリの承認を管理・コントロールするという目的に限って、当社の定めた期間ないしお客様のライセンスが取消され又は本利用規約により期間が満了するまでの期間、本サービスのソフトウェアを使用し、本サービスを利用する世界的、限定的、非独占的、取消可能な、譲渡やサブライセンスが禁止されたライセンスを付与します。
登録及びお客様のアカウント
お客様は、本サービスに登録することができますが、登録を強制されるわけではありません。当社が登録ユーザーに限って本サービスを提供することを定めた場合、当社は事前に通知を行います。
お客様が13歳未満の場合、本サービスを使用しないでください。
お客様の登録の際に、ユーザーネームとして使用されるお客様のeメールアドレスの提供をお願いします。
お客様は、ログインするためにユーザーネームとパスワードを提供しなければなりません。当社は、ログイン、アカウントへのアクセス、本サービスの全部又は一部へのアクセスのため、随時、追加又は別個の識別方法又は認証方法を設定し、要求することがあります。当社は、登録の条件としてお客様から提供いただく情報の詳細をお知らせします。
注意:虚偽、不正確又は古くなった情報は、お客様の登録又は本サービスへのログインを妨げます。
当社は、登録時においてお客様が真実、正確、完全な情報の提供を怠ったことによる結果について、またお客様の情報が拡散され又は第三者に移転した結果としてお客様のアカウントが使用され又は不正に使用されたことについて、一切の責任を負いません。
お客様は、いつでも、当社support@mypermissions.jpに連絡することで、本サービスのソフトウェア(アプリ又はブラウザーアドオン)をアンインストールし、アカウントを終了させ、未登録ユーザーとして本サービスの使用を継続することができます。お客様から連絡があった場合、当社は、お客様の要望の正当性を確認するため、追加の情報をお願いする場合があります。
登録の抹消及び本サービスのアンインストールについては、再度ご確認ください。お客様のアカウントが終了し又はアンインストールされた後は、当社はお客様のアカウントの記録をそれ以上保存することはできません。
お客様は、アカウントの終了後も、本利用規約に従い再登録を行うことで、いつでも登録を再開することができます。
許容される使用
お客様は、本サービスの使用に際し、当社から随時提供される使用ガイドラインを遵守し、国内外の法令、規則、ルールを遵守することに同意します。また、お客様は、本サービスへのアクセス及び使用に関する一切の作為及び不作為について、単独で責任を負うことに同意します。
報酬及びお支払
お客様は、報酬を支払うことで、本サービスの特定の機能にアクセスすることができます。お客様の報酬の支払いは、本サービスの使用の対価です。当社は、いつでもその裁量により、料金及び支払条件を変更することができます。
お支払いは、当社が定める方法によるものとしお客様は支払処理を完了するために必要な情報を提供しなければならず、支払いが完了した後、お客様は本サービスを使用することができるようになります。
当社はいつでも本サービスの支払方法を変更することができます。
お客様は、当社指定の方法により本サービスを解約することができます。お客様からのお支払いは払い戻しすることはできません。
制限
お客様は、本サービスの全部又は一部を、転売、ライセンス、レント、リース、譲渡、賃貸、タイムシェアリング、移転、ミラーリング、再販、展示により第三者に提供することを含め、商業目的又はビジネス目的で使用し、又は本利用規約により明確に許可されていない方法により使用することはできません。
お客様は、次の方法で、本サービスにアクセスすること又は本サービスを使用することはできません。
・当社が本サービスで利用可能としている素材及びコンテンツを改変すること
・本サービスのソフトウェア・コードの改変、二次的著作物の作成、逆アセンブル、デコンパイル、リバース・エンジニアリングを行うこと
・本サービスの機能に干渉し、負荷をかけ、妨害すること
・本サービスの動作及び機能を迂回し、損ない、改ざんすること
・本サービスの技術上の制限を回避・迂回し、本サービスで本来機能せず、アクセス不能で、記載のない要件や機能を有効にするツールを使用すること
・当社の事前の文書による承諾なしに、他のウェブ・ページ又はアプリから、本サービスに対して埋め込みや構成を行い、その他直接のリンクを張ること
・形態の如何に拘わらず、本サービスの測定、スキャニング、クローニング、スクレイピング、プロービング、機械的なナビゲーティング、大部分の抜き出し及びハッキングを行うこと、又は行おうとすること
・類似又は競業する製品又はサービスを開発し、製作すること
・本利用規約や当社が提供した使用説明書又はガイドラインに違反すること
・本サービス、お客様の同一性、他人又は他の法人の代理又は関係性について、虚偽の、ミスリーディングな、又は人を欺く行為や活動を行うこと
・本サービスのセキュリティ、本サービスが使用するネットワーク又はサーバーを侵害し、セキュリティの脆弱性を読み取ること
・プライバシー、名誉棄損、eメールの大量送信、スパム、輸出管理、消費者保護、不正競争、又は虚偽広告に関する法令を含め、刑事犯罪を構成し、民事責任を生じさせ、その他国内外の法令又は業界基準に違反する行為を構成し又は助長する行為を目的として、又はこれに関連して、本サービスを使用すること
・脅迫、嫌がらせ、不正競争、ミスリーディング、欺罔、名誉棄損、中傷、卑猥、猥雑、下品、その他の好ましくないとみなされる行為を目的として、又は当該行為を助長する行為を目的として、又はこれに関連して本サービスを使用すること
・マルウェア、ソフトウェア・ウイルス、トロイの木馬、ワーム及びその他の悪意のあるアプリを本サービスに埋め込み、またはこれらを送信又は頒布のため本サービスを使用すること
・プライバシー、パブリシティ、知的財産権を含む第三者の権利を侵害する情報又は資料、脅迫、侮辱、嫌がらせ、中傷、名誉棄損、俗悪、卑猥、人種又は民族差別に関する情報や資料を、本サービスを通じてアップロードし、掲示し、eメールし、送信し、その他利用可能とすること
アカウントの終了
下記の場合、当社は、法令に基づき当社が取ることができるあらゆる救済手段に加えて、一時的又は永続的にお客様のユーザー・アカウントを拒絶、制限、中止、終了し、お客様による本サービスへのアクセスを禁止し、お客様から本サービスに提供されたコンテンツを削除し、技術的又は法律的にお客様による本サービスの利用を禁止することができます。
・お客様が本サービスを使用する権利を悪用したとき
・お客様が本利用規約に違反したとき
・お客様が法令、規則、又は命令に違反する作為又は不作為を行ったとき
・お客様が、他のお客様や本サービスの提供者を含め、当社又は第三者にとって有害又は有害となり得る作為又は不作為を行ったとき
・本サービスに対する報酬の支払いを怠ったとき
リンク
本サービスは、他のウェブサイトのリンクや第三者によって提供される情報又はコンテンツを含む場合があります。当社は、当該ウェブサイト及びコンテンツを管理又は監視していません。お客様は、当該ウェブサイト又は当該ウェブサイトに掲示されている情報及びコンテンツがお客様のご要望と一致しないこと、好ましくないこと、迷惑であること、不適切であること、違法であること又は不道徳である可能性があります。
当社は、第三者のコンテンツを保証し支援するものではなく、第三者のコンテンツの正確性、信用性、確実性、妥当性、一貫性、適法性を確認するものではなく、第三者のコンテンツ、その有用性、お客様と第三者コンテンツの提供者の間で行われた取引について一切責任を負いません。
プライバシー
当社は、お客様のプライバシーを尊重します。当社のプライバシーポリシーをご参照ください。https://mypermissions.com/privacy?lang=ja_JP プライバシーポリシーは、本利用規約と一体をなすものです。
知的財産権
当社は、本利用規約に基づき、お客様に対して、本サービスのソフトウェアを使用するライセンス及び本サービスを使用する権利を提供します。お客様は、その他の権利を与えられるものではありません。
記事、画像、音声、ビデオ、グラフィックデザイン、データ及びその処理、ソースコード、メイクアップコード、登録の有無にかかわらず、全ての特許権、著作権、商標、商号、サービスマーク、営業秘密、作業方法、作業過程及びその他の知的財産権、これらに関する営業権等本サービスの運営に関係するその他の詳細情報を含め、本サービスにおける及び本サービスに関する権利、権原、利益は、全て当社において所有され、又は当社に対してライセンスされています。
本利用規約又は法律による明確な承認のない限り、お客様は、本サービス、本サービスのソフトウェア、本サービスに関する知的財産権を使用し、又はその他の行為を行うことはできません。当社の事前の明示的な文書による同意なしに、第三者に対して同様のことを承諾することもできません。
お客様は、当社の商標、サービスマーク及びロゴと同一であり、又は混同するほど類似する名称、商標又はロゴを採用し、又は使用することはできません。お客様は、当社の営業権を希釈化し、又は汚染する可能性のあるあらゆる作為又は不作為を避けなければなりません。
当社は、お客様が本サービスにアップデートしたコンテンツについて所有権を主張しません。但し、お客様が本サービスを使用する際、お客様は他人のいかなる権利も侵害しないことを表明保証するものとします。お客様は、お客様が本サービスにアップロードしたコンテンツを当社が他のメディアやプラットフォームで使用し、当社のサービスで表示することに同意します。
コンテンツの削除依頼
当社は、第三者の知的財産権を尊重します。第三者の権利を侵害することを理由に本サービスからコンテンツを削除することを依頼される場合には、当社のコンプライアンスオフイサーcompliance@mypermissions.jp.宛てに連絡ください。当社は、お客様のご要望を検討し、返答し、必要であれば追加の情報を求め、法律に従うために必要であると判断したときは適切な措置を講じます。
変更及び利用可能性
当社は、何らの事前の通知を行うことなく、随時、情報及びコンテンツの有効範囲及び利用可能性のみならず、本サービスの構造、レイアウト、デザイン又はディスプレイを変更することができます。当該性質の変更は、その性質上、故障、エラー及び不自由を引き起こす場合があります。
本サービスの運営の終了
当社は、随時、自由裁量により、一時的又は永続的に、本サービスの全部又は一部の運営を中止する場合があります。当社は、本サービスを終了する前に、事前の通知をすることを義務付けられません。
本規約の変更
当社は、随時、本利用規約を更新することができます。結果に拘わらずマイナーな更新については、当社が注意文書を掲載し、eメールメッセージを送り、本サービスのホームページで告知した7日間後に当該更新は発効します。重要な変更は、当社の通知から30日後に発効します。新方針が発効するまでの間、お客様は新利用規約を承認せず、本サービスをアンインストールし、解約することを選択できます。新利用規約の発効後にマイ・パーミッションズの使用を継続することは、お客様が新利用規約に同意することを意味します。当社が新利用規約を法的要請に適合させる必要がある場合には、新利用規約は直ちに又は必要とされるときに発効することにご注意ください。
担保責任の否認
お客様は、正確性、信頼性、見込まれる結果、市場性、特定の目的のための適合性、非侵害性、互換性、安全性又は本サービスが最新の状態であることについて、何らの担保責任なしに、「現状有姿」で使用するために本サービスが提供されるものであることを承認し、同意します。本サービスの使用は、お客様の単独のご自身のリスクによるものです。
法律で許されている最大限の範囲において、当社は、市場性、見込まれる結果、特定の目的への適合性、非侵害性についての担保責任を含め、本サービス、本サービスの正確性、信頼性、妥当性若しくは完全性、その他のウェブサイト又は他のサービスへのリンクによって提供される資料の全部又は一部についての担保責任、制約、表明及び保証を、明示又は黙示の有無にかかわらず、法律、慣習、事前の口頭若しくは書面での告知、その他に基づくものであるかどうかにかかわらず、明確に否定します。当社の従業員又はそれ以外の者によって作成されたものであろうとなかろうと、容量、使用目的との整合性、本サービスの履行に関係する言明を含め、本利用規約に含まれていない事実の表明、その他の肯定は、いかなる目的においても、当社が担保責任を負うとみなされたり、当社の義務を少しでも生じさせるものとみなされることはありません。
当社は、本サービスをいつでも効率よくアクセスできるよう運営する努力をします。しかしながら、本サービスの運営は、ソフトウェア、ハードウェア及び通信ネットワークなどの多様な要因に左右されます。性質上、当該要因は障害を免れません。当社は、本サービスが絶え間なく、エラーがない方法で動作すること、本サービスが常に利用可能であること、有害なコンポーネントを免れること、当社のコンピューターへの不正アクセスから安全であり、保護されていること、損害を受ける恐れがないこと、当社又はその他のプロバイダーから生じるソフトウェアの故障、通信障害を含むがこれに限らず、機能障害、バグ、故障から免れることを保証しません。当該事例は、本利用規約に対する違反とはみなされません。
責任制限
法律で許されている最大限の範囲において、当社、当社の従業員、役員、株主、アドバイザー、代理人は、不法行為責任であるか、契約責任であるか、その他の性質の責任であるかにかかわらず、本サービスの使用若しくは使用不能、故障、エラー、本サービスの機能停止、当社スタッフ若しくは当社代理人の過失又はエラー、第三者が創作しているコンテンツ若しくは資料に対するお客様自身若しくはお客様のユーザーの信頼、又は本サービスに関する当社若しくは他のお客様とのあらゆるコミュニケーションから生じた直接損害、間接損害、付随的損害、結果的損害、その他の損害、損失(逸失利益及びデータの損失を含む)、経費、費用、支払いについて、当社が当該損害、損失、経費、費用、又は報酬等の発生の可能性をアドバイスされていたか否かに拘わらず、責任を負いません。
免責
お客様は、全ての請求、要求、損害、損失、逸失利益、お客様が本利用規約に違反したことにより被免責者に発生した法的費用及び弁護士報酬を含めた全ての報酬又は費用から、当社、当社の経営者、役員、株主、従業員、外注業者、代理人及び当社を代理して活動する全ての者(「被免責者」といいます。)を、免責し、防御し、害が及ばないようにします(「本免責」といいます。)。
準拠法及び管轄
本利用規約、本サービス、これらから発生し又はこれらに関連する当社に関する全ての請求、訴訟原因、及び紛争については、お客様の出身国やお客様が本サービスにアクセスしている場所に拘わらず、またニューヨーク州以外の法律が適用される結果となる法令抵触の原則に拘わらず、ニューヨーク州の法律が単独で適用されます。
ニューヨーク州ニューヨーク市の裁判所は、本サービス及び本利用規約の有効性、適用性、履行又は解釈に関するあらゆる請求について、単独のかつ独占的な管轄を有します。お客様は、上記裁判所の独占的管轄権に服すること、当該法令によって許されているあらゆる手段によって文書送達を受け取ること、及び一般的には認められている裁判管轄についての抗弁、法律の抵触に関する抗弁、裁判地に関する抗弁を放棄することに同意します。
一般条項
本利用規約は、本書の内容に関する当社とお客様との間の完全な合意を構成するもので、書面又は口頭を問わず、従前の合意、交渉、理解の全部又は一部に取り代わるものです。
書面により明確になされない限り、本利用規約についての又は本規約に関する放棄、和解、期間の延期、表明、変更、追加及び削除は無効です。
譲渡の禁止
お客様は、本利用規約におけるお客様の権利と義務の両方又はいずれか一方を譲渡又は移転することはできません。お客様による譲渡又は移転の試みや、事実上の譲渡又は移転は全て無効です。当社は、本利用規約におけるお客様の権利を損なわないことを条件として、本利用規約における当社の権利及び義務を第三者に譲渡又は移転することができます。
解釈
条文の見出しは、参照の便宜又は読みやすくするためのものであり、解釈の目的で使用されるものではありません。
分離可能性
本利用規約のいずれかの条項が管轄権を有する裁判所によって違法、無効、執行不能、又は法令違反と判断された場合であっても、本利用規約の残りの条項は有効です。

よくある質問と回答
MyPermissionsアプリは、どのようなサービスですか?
モバイル版MyPermissionsは、お使いのデバイスとSNSなどのオンラインサービスからアプリのアクセス情報をスキャンすることで、 どのアプリがあなたの個人情報を取得しているかを調べ、必要があればアクセスを遮断します。当社は、 ユーザーの個人情報や閲覧履歴を収集・保存は一切致しません。
オンラインサービスへサインインを要求されるのは何故でしょうか?
SNSなどのオンラインサービスをスキャンし、ユーザーのプライバシーを保全するため、 My Permissionsはそのアカウントがあなたに紐づいているか確認する必要があります。いかなる状況であっても、 My Permissionsはユーザー情報を閲覧、利用、保存することはございません。
MyPermissions上から、アプリを接続解除を選択した場合、どうなりますか?
アプリの削除を選択した場合、MyPermissionsはオンラインサービスからそのアプリの接続を解除致します。アプリを再度利用したい時は、 再接続をする必要があります。
現状、グーグル+、アンドロイド、Facebookやその他オンラインサービスは、限定的なアクセス許可を認めていません。つまり、 全てのアクセス許可を受け入れるか、アプリを完全に削除することだけが可能です。 個人情報へのアクセスを認めてでも価値があるアプリか否かを決めるのはユーザー様次第であり、 My Permissionsは各アプリが要請するアクセス許可の透明性を保全することに全力を尽くしています。
プロテクションスコアはどうやって算出しているのですか?
プロテクションスコアは、許可もしくは遮断どちらとも選択されていない保留アプリの数によって、算出されています。 スコアを100%にするには、できるだけ保留中のアプリを少なくすることです。
MyPermissions自体を信用できるのでしょうか?
My Permissionsの利用に関して、安全性とセキュリティを必ず保証いたします。個人を特定するような情報、 信用証明書やパスワード等の保存は一切行いません。また、IPアドレスやウェブ閲覧を追跡したりすることもございません。
いくつのデバイスで、My Permissionsを利用することができますか?
一つのMy PermissionsシリアルIDにつき、3台のデバイスまで利用が可能です。
なぜ、iOS上(デバイス)にダウンロードされたアプリは、スキャンできないのですか?
アップル社の利用規約により、デバイス内のアプリはスキャンすることはできません。 My Permissionsは、オンラインサービス上のアクセス情報のみをスキャンします。 ※アンドロイド版は、デバイス内のアプリもスキャンすることが可能。
アプリ・パーミッションズ・コントロール・サービスであるMyPermissionsの所有者である当社(Online Permissions Technologies Ltd.)は、お客様の個人情報が安全に管理され、適切に使用されるよう最大限の努力を行います。

ポリシーの概要
以下は概要となりますので、各項目の詳細につきましては、下記をご覧ください。
お客様から提供された個人識別情報-当社は、登録及び通知を行うために登録の際のお客様のeメールアドレスを使用し、またサービスに対するお客様のお支払いを処理するためにお客様の支払明細(クレジットカード明細ではありません)を使用します。また、当社は、当社との連絡の際にお客様から提供された個人情報を受領することがあります。
当社が収集した個人識別情報-当社は、お客様の個人情報にアクセスすることがあるアプリについてのお客様の承認を確認するため、またお客様が承認の有無を自ら管理することができるようにするため、お客様のソーシャルネットワークのアカウントを使用します。また、当社は、当社のサービスの改善と不正使用防止のため、通常の通信記録、セッションデータ、アプリに関するお客様の承認・不承認に関する情報についても収集を行います。
ご承認のお願い-当社は、アンドロイド・デバイス上での一般的な最小限の承認と、iPhone上で通知をお送りすることについての承認をお願いします。)
お子様のプライバシー-MyPermissionsは、13歳未満のお子様向けではありません。
第三者との情報共有-当社は、支払い処理を行う場合、Facebook上でキャンペーンを行う場合、合併又は買収がなされた場合、お客様が法令に違反し、第三者の権利を侵害し、若しくは当社との契約に違反した際に強制執行を行う場合、第三者との間で情報を共有します。
集計分析情報-当社は、インストールされたアプリのリストを収集し、集計した個人の非識別情報として保存し、使用します。当社は、標準的な分析ツールを使用し、標準的な分析処理を行い、集計した個人の非識別情報を第三者と共有します。
お客様による選択-お客様がソーシャルネットワークアカウントへのログイン情報の提供をお望みでない場合、お客様はMyPersissions.orgを使用することができます。お客様がiPhoneを使用している場合、当社からの通知を受領しないようにすることができます。当社のサービスは、Do Not Track (DNT)信号に応答しません。
お客様の個人情報へのアクセス-お客様は、いつでもお客様の個人識別情報にアクセスすることができます。
データの保存-当社は、サービスを提供し、その他合法かつ適切な目的のために、必要に応じてデータを保存します。
日本国外へのデータの移転-当社は、クラウドのサービスプロバイダーによって運営・管理されるサイトを含め、世界中の様々なサイトにおいて情報を保存し、処理する場合があります。
クッキー-当社は、お客様のログインを簡単にするためにセッションクッキーを使用します。当社の分析ツールはそれ自体のクッキーを使用します。当社は、当社のサービスを提供するために、お客様のソーシャルネットワークアカウントのセッションクッキーを使用します。
情報保護-当社は、お客様の個人情報を保護し、情報の漏洩、損害及び損失によるリスクや、情報への不正アクセス、不正利用によるリスクを最小化するためのシステム、アプリ、プロシージャを実施します。
プライバシーポリシーの変更-当社は、適切な通知をした後、ポリシーを随時更新することができます。

当社では、お客様がMyPermissionsにご登録をする際、お客様のeメールアドレスが必要となります。当社は、お客様のアカウントをアクティブにするためのメッセージの送信、お客様のログインの認証、お客様への通知・連絡(スパムではない)の送信、必要時におけるお客様へのご連絡の目的で、お客様のeメールアドレスを使用することができます。ログイン又は通知のために追加の個人識別情報をお願いする場合、当社は事前に新たなお願いを記載した通知をお送りします。
お客様が当社の有料サービスをご利用される場合、当社は、お客様のお支払を処理した支払サービス提供者から、お客様の支払処理に関する詳細情報(支払額、支払日等)を受領します。当社は、お客様が当社の有料サービスを使用する適格を有することを確認するために当該詳細情報を使用します。当社は、お客様のクレジットカード情報を受領、保存、処理いたしません。
お客様が当社のプライバシー・コンプイライアンス・オフィサー又は他の職員にご連絡された場合、当社は、お客様から提供された個人情報を受領し、処理します。
当社が収集する個人識別情報
MyPermissionsは、ソーシャルネットワークアカウントに接続するアプリについての承認をお客様が管理することができるようにするためのものです。当社は、お客様に代わってソーシャルネットワークサービスにアクセスします。当社は、お客様のソーシャルネットワークアカウントのログイン情報へのアクセスや使用は行いません。当社は、アプリに関するお客様の承認状況を調査し、承認状態を回復し、お客様の要望により承認の取消しやアプリの削除を行い、お客様によるソーシャルネットワークにおけるプライバシー設定の管理を獲得・支援し、お客様の個人情報にアクセスする新しいアプリについて警告をお送りし、お客様ご自身が、信用性のあるアプリについてのお客様のリストにアプリを報告、追加、削除することが出来るようにします。
上記の目的のため、当社は、ソーシャルネットワークがお客様のデバイス上に記録している「セッション」(ログイン)クッキーを読み取ることが必要になります。クッキーについての更なる情報が必要な場合、下記の「クッキー」の項をご覧ください。
当社は、「セッション」又は「トラフィック」として知られる更なる情報を収集します。この種のデータは、当社のサーバーに記録され、お客様のデバイスの閲覧情報、セッション持続時間、お客様のデバイス上のOSの種類等の情報を含みます。
当社は、当社のサービスがスパム、ロボット、又は他の不正使用を除去していることを確認するために、お客様のIPアドレスを収集します。例えば、当社は、あるアプリが信用できることを示すために「信用」という選択肢をクリックしたお客様のIPアドレスや、当社から認証され又は認証されていないアプリのウェブページにコメントを書いたお客様のIPアドレスを収集します。
当社は、お客様のプロフィールの作成及び商品化に従事するものではありません。当社は、当社のサービスの理解又は改善のため、また当社のサービスの信頼性及び安全性の向上のため、分析目的(集計分析情報の項をご覧ください)で当該データを収集します。
当社は、お客様のソーシャルネットワークアカウントに接続する他のサイトの情報を受領し、統計を取るための処理を行います。当社は、お客様がアプリに与えた承認やアプリに対する同意又は拒否を解析することで当社のサービスを改善するため、これらの情報を使用します。
当社は、お客様がサポート(例えば、お客様がアカウントにログインするために当社のヘルプを必要とする場合)を受けるために当社にご連絡をされた場合、サポートを行う目的で、お客様のデバイス(OSのバージョン、デバイスのモデル等)についての詳細情報を受領します。
当社からのご承認のお願い
お客様がアンドロイド端末をご使用の場合、当社は、インターネットにアクセスし、自動的にMyPermissionsをデバイス上で再起動し、デバイスがスリープモードに切り替わるのを防止することについて、お客様の承認をお願いします。当社は、お客様のためにアプリをスキャンし、お客様の個人情報へのアクセスを必要とするアプリについてのリアルタイムのアラートを提供することを含め、当社のサービスを提供するためにお客様の承認を必要とします。当社が更にお客様の承認を必要とする場合、当社は、明確な形でお客様に承認を依頼します。
お客様がiPhoneをご使用の場合、お客様の承認をいただくために、お客様に対して承認依頼の通知をお送りします。
現在、ブラウザーは承認処理を提供していません。お客様が当社の「クリーナー」というブラウザー・アドオンをご使用される場合、当社は、本ポリシーに記載する方法により、お客様の個人情報にアクセスします。
お子様のプライバシー
13歳未満のお子様は、MyPermissionsをご使用になることができません。当社は、故意に又は意図的に13歳未満のお子様の個人情報を収集することはありません。更なる情報が必要な場合、次の当社プライバシー・コンプライアンス・オフィサーにご連絡ください。privacy@mypermissions.jp.
第三者との情報共有
当社は、お客様の個人識別情報を売却、賃貸、又はリースすることはありません。但し、当社は、当社のマーケティング・キャンペーンのためのプラットフォームとしてFacebookを利用していますので、Facebookがお客様の情報にアクセスする場合があります。当社はお客様の支払いを処理し又は確認するため、お客様の支払処理に関する明細を支払サービス提供者と共有します。また、当社が合併又は買収された場合、お客様の個人情報を別会社に移転することが必要となる場合があります。但し、情報を受領する会社はこのポリシーに従うものとします。
当社は法令を遵守しており、お客様も同様であることを期待します。当社は、MyPermissionsの詐欺、流用、侵害、なりすまし、その他の違法行為、及び不正使用を防止するため、又はMyPermissionsに関してお客様と当社の間、又はお客様と他のお客様ないし第三者との間での紛争について訴訟を行い又は法的手続を行うため、お客様の個人情報を使用し、必要に応じてお客様の個人情報を第三者と共有しなければならない場合があります。当社は、裁判所又は司法当局によって発せられた命令及び令状にも従います。
統計・分析情報
当社は、お客様のデバイスからインストールされているアプリのリストを収集します。当社は、当社のサービスを提供し、管理し、改善するため、例えばアプリの評判や有効期間を追跡調査するなど、統計的な手法で個人の識別ができない方法に限定して、当該リストを使用します。当社は、インストールされているアプリのリストを第三者と共有しません。

Google アナリティクスは、サービス提供のためにクッキーを使用します。クッキーの詳細情報については、下記の「クッキー」の項をご覧ください。
当社は、正当な事業目的のため、匿名の、統計的、又は集合的情報を使用し、当該情報を当社のパートナーと共有する場合があります。お客様と関連づけることができるデータを集合情報から抽出する適切な方法はありませんので、これはお客様のプライバシーに影響を及ぼしません。
選択
当社は、MyPermissionsを作動するため、お客様に対して必要最小限の情報提供と承認をお願いします。但し、お客様は、お客様のソーシャル・ネットワーク・アカウントのログイン情報を当社に提供しないことを選択することができます。この場合、お客様はMyPermissions.orgにアクセスし、お客様の承認を手動で管理することにより、当社のサービスを使用することができます。
お客様は、いつでも、当社ウェブサイトのサポート部門を通じて、あるいは当社のアドレスsupport@mypermissions.jp.に連絡することによって、当社に対してお客様のアカウントの削除を求めることができます。当社は、お客様のご要望を受けてから2営業日以内にアカウントを削除します。
お客様がiPhoneのユーザーであり、当社からの通知を受領することに同意した場合、お客様は、その選択により、いつでも通知の受領を中止することができます。
ウェブブラウザーには、「Do Not Track」(「DNT」)信号を提供するものがあります。DNT信号とは、サービス上でのお客様の活動を追跡し、あるいはクロスサイトでお客様の活動を追跡して、お客様の選好を示すHTTPのヘッダーフィールドです。当社のサービスは、DNT信号に応答しません。
お客様の個人情報へのアクセス
お客様は、いつでも、当社のプライバシー・コンプイライアンス・オフィサー(アドレス:compliance@mypermissions.jp)に連絡し、当社が有するお客様の個人識別情報にアクセスすることを要求することができます。当社は、お客様のご本人確認を行うため信頼できる証明書の提出をお願いすることがあります。お客様が、お客様のアカウントの情報が不正確、不完全、未更新であることに気付いた場合、訂正のために必要な情報を当社にご提供ください。
データの保存
当社は、法令の規定に従い、情報処理又は当社の正当な事業目的に応じて、種類の異なる情報を、それぞれの異なった期間保存します。例えば、当社は、課税庁からの要求、アカウントの清算、帳簿の管理、統計目的、法律問題のために、お客様が行った支払いに関する情報を数年間保存しなければならない場合があります。
当社は、統計的な非識別情報を無制限に保存することができ、当該情報の処理が必要なくなった場合、当該情報を削除し、又は潜在的に識別可能な情報を匿名化します。
法律によって情報の削除が要求され、又は当社の裁量により情報の削除を決定した場合を除き、いかなる場合であっても、お客様がMyPermissionsを使用する間は、当社はお客様の情報を保存します。
国外へのデータ移転
MyPermissionsは、本来オンラインサービスであり、クラウドのサービス提供者によって運営・管理されるサイトを含め、世界中の各種のサイトで情報を保存し、処理することができます。お客様が、お客様の個人情報を外国に移転するのにお客様の同意を必要とする国に居住している場合、お客様は当社に対し、当該移転についての明確な承諾を与えるものとします。
クッキー
クッキーは、お客様のブラウザーに送られ、当該ブラウザーからクッキーを送ったサーバーに対してアクセスするたびに、ブラウザーによって送り返される情報のパケットです。上記で説明されているように、当社は、お客様に当社のサービスを提供するために、ソーシャルネットワークのクッキーを読み取り、分析ツールは、当社に分析サービスを提供するために、それ自体のクッキーを使用します。当社は、お客様が登録ユーザーである場合、お客様がより簡易にログインすることができるようにするためにセッションクッキーも使用します。
お客様は、ブラウザーとスマートフォンの設定を通じて、お好きなクッキーを使用することができます。しかし、無効化クッキーはMyPermissionsの使用を複雑化し、MyPermissionsの使用をできなくさせることがあることにご注意ください。
情報保護
当社は、可能な限り少ない情報を保存し、センシティブ情報の保存は避けるように努力します。当社及び当社のホスティング・サービスは、お客様の個人情報を保護し、盗難、損害、情報の紛失、不正アクセス又は不正利用のリスクを最小限に減らすため、システム、アプリ、プロシージャを提供しています。これらの方法は、しっかりとした業界標準のセキュリティを提供します。但し、当社はお客様のプライバシーを保護する努力を行いますが、MyPermissionsがあらゆる犯罪、誤動作、違法な干渉又はアクセス、その他の不正使用から免れることをお約束することはできません。
プライバシーポリシーの変更
当社は、いつでもこのプライバシーポリシーを更新することができます。更新が重大な影響を及ぼすものでない場合、当社が警告書を掲載し、eメールのメッセージを送り、当該サービスのホームページで告知した7日間後に発効します。重要な変更については、当社の通知から30日後に発効します。新ポリシーが発効するまでの間、お客様は新ポリシーを承認せず、MyPermissionsをアンインストールすることを選択できます。新ポリシーの発効後にMyPermissionsの使用を継続することは、お客様が新ポリシーに同意することを意味します。当社がポリシーを法令に適合させる必要がある場合には、新ポリシーは直ちにあるいは必要とされるときに発効することにご注意ください。

1. Your relationship with Google.
1.1 Use of the Service is Subject to these Terms. 2. Accepting the Terms.
2.1 Clicking to Accept or Using the Maps API(s). In order to use the Maps API(s), you must agree to the Terms by:
- clicking to accept the Terms, where this option is made available to you by Google in the Service’s user interface; or
- using the Maps API(s). You understand and agree that Google will treat your use of the Maps API(s) as acceptance of the Terms from that point onwards.
2.2 U.S. Law Restrictions. You may not use the Maps API(s) and may not accept the Terms if you are a person barred from using the Service under United States law.
2.3 Authority to Accept the Terms. You represent that you have full power, capacity, and authority to accept these Terms. If you are accepting on behalf of your employer or another entity, you represent that you have full legal authority to bind your employer or such entity to these Terms. 3. Privacy and Personal Information.

3.2 Use of Your Data under Google’s Privacy Policy. You agree to the use of your data in accordance with Google’s Privacy Policy.
3.3 Your Privacy Policy. You must post and abide by an appropriate privacy policy in your Maps API Implementation in accordance with Section 9.3 (End User Terms and Privacy Policy).
3.4 Applicable Privacy Laws. You will comply with all applicable laws relating to the collection of information from visitors to your Maps API Implementation.
4. Provision of the Service by Google.
4.1 Google’s Subsidiaries and Affiliates. Google has subsidiaries and affiliated legal entities around the world (“Subsidiaries and Affiliates“). Sometimes, these companies will be providing the Service to you on behalf of Google itself. You understand and agree that Subsidiaries and Affiliates will be entitled to provide the Service to you.
4.2 Limits on Your Use of the Service. You understand and agree that Google may limit the number of transactions you may send or receive through the Service; such fixed upper limits may be set by Google at any time, at Google’s discretion. For further information, see Section 10.4(b) below.
4.3 Advertising.
- In places results. Google reserves the right to include advertising in the places results provided to you through the Maps API(s). By using the Maps API(s) to obtain places results, you agree to display such advertising in the form provided to you by Google.
- In maps images. Google also reserves the right to include advertising in the maps images provided to you through the Maps API(s), subject to the following provisions. In this Section, “Ads Notice” means a notice from Google that it will include advertising in a particular Maps API. The Ads Notice may be provided on relevant Google websites, including the Google Geo Developers Blog (or such other URL as Google may provide) and the applicable Google Maps API Groups.
- New Maps API(s) and major version upgrades of existing Maps API(s) launched with an Ads Notice. A “major version” of a Maps API is denoted by a new “whole number” in the version name (for example, a “major version” change occurs if API v4.5 is replaced by v5.0). By using the maps images in these new or major version upgrades of the Maps API(s), you agree to display the advertising included in those maps images in the form provided to you by Google.
- Maps API(s) and major version upgrades of existing Maps API(s) launched without an Ads Notice. For any Maps API that Google has launched (or launches in the future) without an Ads Notice, Google will not include advertising in that API’s maps images unless Google provides you with an Ads Notice at least 90 days beforehand (the “Ads Notice Period”).
- Maps API Implementations that incorporated the Maps API(s) before April 8, 2011. If your Maps API Implementation incorporated a major version of a Maps API before April 8, 2011, you have a limited right to opt out of advertising in the maps images provided through that major version of that Maps API by providing written notice to Google during the Ads Notice Period; your notice must state that you refuse to accept advertising in the maps images and must be provided to Google in accordance with Google’s notice requirements (as specified in Google’s Ads Notice).
- Opting out of ads. You may at any time opt out of advertising in the places results and the maps images by either:
- contacting the Google Maps sales team to obtain a Google enterprise license; or
- terminating your use of the Service.
- Indexing and caching for ads serving. By using an API that serves ads, you give Google the right to access, index, and cache the web pages or applications that contain your Maps API Implementation.
4.4 Changes to the Service; Deprecation Policy. The following is the Service’s “Deprecation Policy”:
- Google will announce if it intends to remove major features from, or discontinue, an API or the Service.
- Google will use commercially reasonable efforts to continue to operate those Google Maps API versions and features identified at http://developers.google.com/maps/maps-api-list without these changes until one year after the announcement, unless Google determines in its reasonable good faith judgment that:
- it is required by law or third-party relationship (including changes in law or relationships) to make those changes earlier; or
- doing so could create a security risk or substantial economic or material technical burden.
5. Your Google Account.
5.1 Signing Up for a Google Account. In order to access the Service, you must have and maintain aGoogle Account in good standing. You must ensure that any information you give to Google in connection with your Google Account or the Service will always be accurate, correct, and up to date.
5.2 Your Passwords and Account Security. You will be solely responsible to Google for your use of the Service. You must notify Google immediately if you become aware of any unauthorized use of your password; your Google Account; or any unique identifier that Google requires you to use, such as an API Key or client ID (a “Developer Identifier“).
6. Google’s Proprietary Rights.
You understand and agree that Google and its licensors and their suppliers (as applicable) own all legal right, title, and interest in and to the Service and Content, including any intellectual property rights in the Service and Content (whether those rights are registered or not, and wherever in the world those rights may exist).
7. Permitted Uses.
You will use the Service only for purposes that:
- are permitted by the Terms (including the Licenses in Section 8);
- are permitted by any applicable law or third-party contract in the relevant jurisdictions; and
- comply with all applicable policies or guidelines made available by Google, including in the Maps APIs Documentation and the Permission Guidelines for Google Maps and Google Earth.
8. Licenses from Google to You.
8.1 Definitions.
- “Brand Features” means trade names, trademarks, logos, domain names, and other distinctive brand features.
- “Content” means any content provided through the Service (whether created by Google or its third-party licensors), including map and terrain data, imagery, traffic data, and places data (including business listings).
- “Maps API Implementation” means a software application, website, or other implementation that uses the Maps API(s) to obtain and display Content in conjunction with Your Content.
- “Your Content” means any content that you provide in your Maps API Implementation, including data, images, video, or software. Your Content does not include the Content as defined in Subsection (b).
8.2 Service License. Subject to these Terms (including Section 9 (License Requirements) and Section 10 (License Restrictions)), during the term of this agreement, Google gives you a non-exclusive, worldwide, personal, non-transferable, non-assignable, non-sublicensable, royalty-free license to use the Service as provided by Google, in the manner permitted by the Terms.
8.3 Content License. Subject to these Terms (including Sections 8.3(a) and (b), Section 9 (License Requirements), and Section 10 (License Restrictions)), during the term of this agreement, Google gives you a non-exclusive, worldwide, personal, non-transferable,non-assignable, non-sublicensable, royalty-free license to use the Content in your Maps API Implementation, as the Content is provided in the Service, and in the manner permitted by the Terms.
- Content (including map data, traffic, directions, and places) is provided for planning purposes only. You may find that weather conditions, construction projects, closures,or other events may cause road conditions or directions to differ from the results depicted in the Content. You should exercise judgment in your use of the Content.
- Certain Content is provided under license from third parties, and is subject to copyright and other intellectual property rights owned by or licensed to such third parties. You may be held liable for any unauthorized use of this content. Your use of third-party Content (including certain business listings Content) is subject to additional restrictions located in the Legal Notices page.
8.4 Brand Features License.
- Grant. Subject to these Terms (including Section 8.4(b), Section 9 (License Requirements), andSection 10 (License Restrictions)), during the term of this agreement, Google gives you a non-exclusive, worldwide, personal, non-transferable, non-assignable, non-sublicensable, royalty-free license to display Google’s Brand Features solely for the purposes of (i) promoting or advertising your authorized use of the Service in accordance with this Section and (ii) fulfilling your obligations under the Terms.
- Restrictions. In using Google Brand Features, you will not:
- display a Google Brand Feature in any manner that implies a relationship or affiliation with, sponsorship, or endorsement by Google (other than your use of the Service), or that can be reasonably interpreted to suggest editorial content has been authored by, or represents the views or opinions of, Google or its personnel;
- display a Google Brand Feature in your Maps API Implementation, site, or other propert(ies) if any of them contain or display adult content or promote illegal activities, gambling, or the sale of tobacco or alcohol to persons under 21 years of age;
- have the Google logo as the largest logo in your Maps API Implementation, site, or other propert(ies) (except as displayed in the map image itself);
- display a Google Brand Feature as the most prominent element in your Maps API Implementation, on any page of your site, or on any of your other propert(ies);
- display a Google Brand Feature in a manner that is misleading, defamatory, infringing, libelous, disparaging, obscene, or otherwise objectionable to Google;
- use Google Brand Features to disparage Google or the Google Services;
- display a Google Brand Feature in your Maps API Implementation, site, or other propert(ies) that violate any law or regulation; or
- remove, distort, or alter any element of a Google Brand Feature (including squeezing, stretching, inverting, or discoloring).
- No further license grant; no challenges. Except as stated in this Section, nothing in the Terms grants or will be deemed to grant you any right, title, or interest in Google’s Brand Features. Your use of Google’s Brand Features (including any goodwill associated with them) will inure to Google’s benefit. During and after the Term, and to the maximum extent permitted by applicable law, you will not challenge or assist others to challenge Google’s Brand Features (or their registration by Google), and you will not attempt to register any Brand Features (including domain names) that are confusingly similar to Google’s in any way (including in sound, appearance, or spelling).
8.5 Proprietary Rights Notices. You will not remove, obscure, or alter any proprietary rights notices (including copyright and trademark notices, Terms of Use links, or Brand Features) displayed or provided through the Service. Where such notices are not displayed or provided within the Service, you must display such notices according to the Maps APIs Documentation.
8.6 U.S. Government Restricted Rights. If the Service or Content is being used or accessed by or on behalf of the United States government, such use is subject to additional terms located in our Legal Notices page’s “Government End Users” section.
8.7 Determination of Compliance. Google reserves the sole right and discretion to determine whether your use of the Service, Content, and Brand Features complies with these Terms.
9. License Requirements.
Google’s licenses above are subject to your compliance with the following requirements:
9.1 Free, Public Accessibility to Your Maps API Implementation.
9.1.1 General Rules.
- Free access (no fees). Subject to Section 9.1.2 (Exceptions), your Maps API Implementation must be accessible to the general public without charge and must not require a fee-based subscription or other fee-based restricted access. This rule applies to Your Content and any other content in your Maps API Implementation, whether Your Content or the other content exists now or is added later.
- Public access (no firewall). Your Maps API Implementation must not operate (i) only behind a firewall; or (ii) only on an internal network (except during the development and testing phase); or (iii) in a closed community (for example, through invitation-only access).
9.1.2 Exceptions.
- Enterprise agreement with Google. The rules in Section 9.1.1 (Free access, Public access) do not apply if you have entered into a separate written agreement with Google (such as a Google Maps agreement) or obtained Google’s written permission.
- Mobile applications.
- The rule in Section 9.1.1(a) (Free access) does not apply if your Maps API Implementation is used in a mobile application that is sold for a fee through an online store and is downloadable to a mobile device that can access the online store.
- The rule in Section 9.1.1(b) (Public access) does not apply if your Maps API Implementation is an Android application that uses the Google Maps Android API. (However, the rule in Section 9.1.1(b) (Public access) will continue to apply if your Maps API Implementation is an Android application that uses any other Maps APIs, unless the Maps API Implementation qualifies for the exception in Section 9.1.2(a) (Enterprise agreement with Google).)
9.1.3 Examples.
- You can require users to log in to your Maps API Implementation if you do not require users to pay a fee.
- You can charge a fee for your Maps API Implementation if it is an Android application downloadable to mobile devices from the Google Play Store.
- If you are a consultant who creates or hosts Maps API Implementations for third-party customers, you may charge those customers a fee for your consulting or hosting services (but not for the Maps API Implementations themselves, except as permitted under Section 9.1.2 (Exceptions)).
9.2 Reporting. You must implement those reporting mechanisms that Google requires (as updated from time to time in these Terms and in the Maps APIs Documentation).
9.3 End User Terms and Privacy Policy. If you develop a Maps API Implementation for use by other users, you must:
- display to the users of your Maps API Implementation the link to Google’s Terms of Service as presented through the Service or described in the Maps APIs Documentation;
- explicitly state in your Maps API Implementation’s terms of use that, by using your Maps API Implementation, your users are agreeing to be bound by Google’s Terms of Service; and
- protect the privacy and legal rights of those users.
- Your privacy policy. You must make publicly available, and must abide by, an appropriate privacy policy in your Maps API Implementation. In particular, if your Maps API Implementation enables you or any party to gain access to information about users of the Maps API(s), including personally identifiable information (such as user names) or non-personally identifiable usage information (such as location), your privacy policy must describe your use and retention of this information.
- Geolocation privacy
- Your Maps API Implementation must notify the user in advance of the type(s) of data that you intend to collect from the user or the user’s device. Your Maps API Implementation must not obtain or cache any user’s location in any manner except with the user’s prior consent. Your Maps API Implementation must let the user revoke the user’s consent at any time.
- If your Maps API Implementation provides Google with geolocation data, that geolocation data must not enable Google to identify an individual user. For example, if your Maps API Implementation sends Google Your Content, and Your Content includes geolocation data, Your Content must not also include unique device identifiers associated with individual users.
- If you intend to obtain the user’s location and use it with any other data provider’s data, you must disclose this fact to the user.
- Google’s Privacy Policy. Your privacy policy must notify users that you are using the Maps API(s) and incorporate by reference Google’s Privacy Policy by including a link to Google’s then-current Privacy Policy (at http://www.google.com/policies/privacy or such other URL as Google may provide).
- Cookies. As noted in the Documentation, certain Maps API(s) store and access cookies and other information on end users’ devices. If you use any of these cookie-enabled Maps API(s) in your Maps API Implementation, then for end users in the European Union, you must comply with the EU User Consent Policy.
- Geolocation privacy
- Your privacy policy. You must make publicly available, and must abide by, an appropriate privacy policy in your Maps API Implementation. In particular, if your Maps API Implementation enables you or any party to gain access to information about users of the Maps API(s), including personally identifiable information (such as user names) or non-personally identifiable usage information (such as location), your privacy policy must describe your use and retention of this information.
9.4 Attribution.
- Content provided to you through the Service may contain the Brand Features of Google, its strategic partners, or other third-party rights holders of content that Google indexes. When Google provides those Brand Features or other attribution through the Service, you must display such attribution as provided (or as described in the Maps APIs Documentation) and must not delete or alter the attribution.
- You must conspicuously display the “powered by Google” attribution (and any other attribution(s) required by Google in the Maps APIs Documentation) on or adjacent to the relevant Service search box and Google search results. If you use the standard Google search control, or the standard Google search control form, this attribution will be included automatically, and you must not modify or obscure this automatically-generated attribution.
- You understand and agree that Google has the sole right and discretion to determine whether your attribution(s) are in compliance with the above requirements.
9.5 Preventing Unauthorized Use. You will use all reasonable efforts to prevent unauthorized use of the Service and to terminate any such unauthorized use.
9.6 Responsibility for Breaches. You are solely responsible for (and Google has no responsibility to you or any third party for) any breach of your obligations under the Terms and for the consequences of any such breach (including any loss or damage that Google may suffer).
10. License Restrictions.
Except as expressly permitted under the Terms, or unless you have received prior written authorization from Google (or, as applicable, from the particular Content provider), Google’s licenses above are conditioned on your adherence to all of the restrictions below. In this Section 10, the phrase “you will not” means “when using the Service, you will not, and will not permit a third party to.”
10.1 Administrative Restrictions.
- No access to APIs or Content except through the Service. You will not access the Maps API(s) or the Content except through the Service. For example, you must not access map tiles or imagery through interfaces or channels (including undocumented Google interfaces) other than the Maps API(s).
- No access to Service without applicable Developer Identifier(s). For certain versions or features of the Maps API(s), Google may require you to use a Developer Identifier to access and administer the Service. If a Developer Identifier is required under the Maps APIs Documentation, you will not access the Service without the Developer Identifier.
- No hiding identity. You will not hide from Google the identity of your Maps API Implementation. You must follow the identification conventions in the Maps APIs Documentation.
10.2 General Google API Restrictions. The following restrictions apply generally to all Google Services, including the Google application programming interfaces at https://developers.google.com/products/(or such other URL as Google may provide) (the “Google API(s)”). You will not:
- Sublicense a Google API for use by a third party. Consequently, you will not create an API client that functions substantially the same as the Google APIs and offer it for use by third parties.
- Perform an action with the intent of introducing to Google Services any viruses, worms, defects, Trojan horses, malware, or any items of a destructive nature.
- Defame, abuse, harass, stalk, or threaten others.
- Interfere with or disrupt the Google APIs or the servers or networks providing the Google APIs.
- Promote or facilitate unlawful online gambling or disruptive commercial messages or advertisements.
- Reverse engineer or attempt to extract the source code from any Google API or any related software, except to the extent that this restriction is expressly prohibited by applicable law.
- Use the Google APIs for any activities where the use or failure of the Google APIs could lead to death, personal injury, or environmental damage (such as the operation of nuclear facilities, air traffic control, or life support systems).
- Use the Google APIs to process or store any data that is subject to the International Traffic in Arms Regulations maintained by the U.S. Department of State.
- Remove, obscure, or alter any Google terms of service, or any links to or notices of those terms.
10.3 Quality Standards Restrictions.
- No violation of Google’s Software Principles. You will not violate Google’s Software Principles athttp://www.google.com/intl/en/about/company/software-principles.html (or such other URLs that Google may designate).
- No modification of search results. You will not modify, reorder, augment, or manipulate search results in any way unless you explicitly notify the end user of your actions.
10.4 Restrictions on Unfair Exploitation of the Service and Content.
- No use except under these Terms. You will not use the Service or Content except as expressly permitted under these Terms. For example:
- No fees. You will not charge any third party a fee to use your Maps API Implementation, the Service, or the Content, unless you have purchased an applicable Google Maps APIs Premium Plan or Google Maps APIs for Work license that expressly permits this use.
- No printing 5,000+ copies for direct marketing. You will not print more than 5,000 copies of sales collateral materials containing a screenshot of the Content for purposes of commercial sales lead generation.
- No use as a core part of printed matter. You will not incorporate the Content as a core part of printed matter (such as a printed map or guide book) that is redistributed for a fee.
- No use beyond transaction limits and usage policies. If your Maps API Implementation generates a high volume of transactions, Google reserves the right to set transaction limits, as described in the Maps APIs Documentation here. Google also reserves the right to set other usage policies in the Documentation from time to time. If you want to engage in use outside these transaction limits or usage policies, you can purchase more usage capacity through the Maps API Standard pricing plan, or you can contact the Google Maps sales team for licensing options to address your needs. Google may decline your request, or condition acceptance on your agreement to additional terms and/or charges for that use.
- Restrictions on your Maps API Implementations.
- No creation of a substitute service. You will not use the Service to create a Maps API Implementation that is a substitute for, or substantially similar service to, Google Maps (at https://www.google.com/maps (or such other URL as Google may provide)) (“Google Maps“) or the Service.
- No creation or augmentation of data sets based on Google’s Content or Services. You will not use Google’s Content or Services to create or augment your own mapping-related dataset (or that of a third party), including a mapping or navigation dataset, business listings database, mailing list, or telemarketing list.
- No navigation. You will not use the Service or Content for or in connection with (a) real-time navigation or route guidance; or (b) automatic or autonomous vehicle control.
- No asset-tracking unless you have purchased the applicable enterprise license. Unless you have purchased an applicable Premium Plan or Maps APIs for Work license that expressly permits you to do so, you will not use the Service or Content for commercial asset-tracking or in Maps API Implementations whose primary purpose is to assess vehicle insurance risks.
- Commercial asset-tracking includes dispatch, fleet management, and Maps API Implementations that track your (or your end users’) assets (for example, private or commercial transportation applications, including taxi and vehicle-for-hire applications).
- Non-commercial asset-tracking implementations include applications used for a non-commercial purpose (for example, a free, publicly accessible Maps API Implementation that displays real-time public transit or other transportation status information or that allows end users to share real-time location with others).
- No use of Content in a listings service. You will not use business listings-related Content in any Customer Implementation that has the primary purpose of making available business, residential address, or telephone directory listings.
- No use of Content for an Ads product. You will not use business listings-related Content to create or augment an advertising product.
- No use of Content without a Google map. Unless the Maps APIs Documentation expressly permits you to do so, you will not use the Content in a Maps API Implementation without a corresponding Google map. For example, you may display Street View imagery without a corresponding Google map because the Maps APIs Documentation expressly permits this use.
- No use of Content with a non-Google map. You must not use the Content in a Maps API Implementation that contains a non-Google map.
10.5 Intellectual Property Restrictions.
- No distribution or sale except as permitted under the Terms. You will not distribute, sell, or otherwise make any part of the Service available to third parties except as permitted by these Terms.
- No derivative works. You will not modify or create a derivative work based on any Content unless expressly permitted to do so under these Terms. For example, the following are prohibited: (i) creating server-side modification of map tiles; (ii) stitching multiple static map images together to display a map that is larger than permitted in the Maps APIs Documentation; or (iii) tracing or copying the copyrightable elements of Google’s maps or building outlines and creating a new work, such as a new mapping or navigation dataset.
- No use of Content outside the Service. You will not use any Content outside of the Service except as expressly permitted to do so in Subsection (d). For example, you will not export or save the Content to a third party’s platform or service.
- No caching or storage. You will not pre-fetch, cache, index, or store any Content to be used outside the Service, except that you may store limited amounts of Content solely for the purpose of improving the performance of your Maps API Implementation due to network latency (and not for the purpose of preventing Google from accurately tracking usage), and only if such storage:
- is temporary (and in no event more than 30 calendar days);
- is secure;
- does not manipulate or aggregate any part of the Content or Service; and
- does not modify attribution in any way.
- No mass downloading. You will not use the Service in a manner that gives you or a third party access to mass downloads or bulk feeds of any Content. For example, you are not permitted to offer a batch geocoding service that uses Content contained in the Maps API(s).
- No incorporating Google software into other software. You will not incorporate any software provided as part of the Service into other software.
- No removing, obscuring, or altering terms of service, links, or proprietary rights notices. You will not:
- remove, obscure, or alter any Google terms of service or any links to or notices of those terms, or any copyright, trademark, or other proprietary rights notices; or
- falsify or delete any author attributions, legal notices, or other labels of the origin or source of material.
10.6 Restrictions on Trying to Shut Down the Service. We want to make sure that the Services remain online and available for all users. To help ensure this, during the agreement term, you will not try to shut down the Services that you have been using by seeking an injunction or exclusion order.
11. Licenses from You to Google.
11.1 Content License. Google claims no ownership over Your Content, and you retain copyright and any other rights you already hold in Your Content. By submitting or displaying Your Content through the Service, you give Google a perpetual, irrevocable, non-exclusive, worldwide, sublicensable, royalty-free license to use Your Content solely for the following purposes:
- enabling Google to provide you with the Service;
- if you opt to do so through your Maps API Implementation’s features, allowing end users to use Your Content in Google Services; and
- if you opt to submit Your Content through the Google Places API(s), allowing Google to use that content in Google Services.
11.2 Marketing License. During the term of this agreement, you give Google a non-exclusive, worldwide, sublicensable, royalty-free license to use Your Brand Features and Your Content to publicize or advertise that you are using the Service (for example, by using your marks in presentations, marketing materials, customer lists, financial reports, and website listings (including links to your website), or by creating marketing or advertising materials that show screenshots of the Service in which Your Content is featured).
11.3 Authority to Grant Licenses. You represent and warrant that you have all the rights, power, and authority necessary to grant the above licenses.
12. Maps API Standard Pricing Plan and Payment Terms.
This Section 12 applies if you purchase usage capacity (beyond the Service’s transaction limits) through the Maps API Standard pricing plan:
12.1 Free Quota. Certain parts of the Service are provided to you without charge up to the transaction limits described in the Maps APIs Documentation here.
12.2 Online Billing. Google will issue an electronic bill to you for all charges accrued above the transaction limits based on your use of the Service during the previous month. You will pay all fees specified in the invoice, including the invoice’s specified currency and payment terms. Google’s measurement of your use of the Service is final.
12.3 Taxes. In association with your purchase of Maps API usage, you are responsible for all applicable government-imposed taxes, except for taxes based on Google’s net income, net worth, employment, and assets (including personal and real property) (“Taxes“), and you will pay Google for the Service without any reduction for Taxes. If Google is obligated to collect or pay Taxes, the Taxes will be invoiced to you, unless you provide Google with a timely and valid tax exemption certificate authorized by the appropriate taxing authority. In some states the sales tax is due on the total purchase price at the time of sale and must be invoiced and collected at the time of the sale.
12.4 Invoice Disputes & Refunds. To the fullest extent permitted by law, you waive all claims relating to fees unless claimed within sixty days after charged (this does not affect any of your rights with your credit card issuer). Refunds (if any) are at Google’s discretion and will only be in the form of credit for the Service. Nothing in these Terms obligates Google to extend credit to any party.
12.5 Delinquent Payments. Late payments may bear interest at the rate of 1.5% per month (or the highest rate permitted by law, if less). Google reserves the right to suspend your access to the Service for any late payments.
13. Terminating this Agreement.
13.1 The Terms will continue to apply until terminated by either you or Google as described below.
13.2 You may terminate your legal agreement with Google by removing the Maps API(s) code from your Maps API Implementation and discontinuing your use of the Service at any time. You do not need to specifically inform Google when you stop using the Service.
13.3 Google reserves the right to terminate these Terms or discontinue the Service, or any portion or feature of the Service, for any reason and at any time without liability or other obligation to you, except as described under Section 4.4 (Changes to the Service; Deprecation Policy).
13.4 Nothing in this Section 13 will affect Google’s rights under Section 4 (Provision of Service by Google).
13.5 When this legal agreement comes to an end, those Terms that by their nature are intended to continue indefinitely will continue to apply, including Sections 6 (Google’s Proprietary Rights); 11.1 (Content License); 13.4 and 13.5 (Terminating this Agreement); 14 (Exclusion of Warranties); 15 (Limitations of Liability); 16 (Indemnities); and 19 (General Legal Terms).
14. EXCLUSION OF WARRANTIES.
14.1 NOTHING IN THESE TERMS, INCLUDING SECTIONS 14 AND 15, WILL EXCLUDE OR LIMIT GOOGLE’S WARRANTY OR LIABILITY FOR LOSSES THAT MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF LOSS OR DAMAGES. ACCORDINGLY, ONLY THE LIMITATIONS THAT ARE LAWFUL IN YOUR JURISDICTION WILL APPLY TO YOU, AND GOOGLE’S LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
14.2 YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE AND THE CONTENT IS AT YOUR SOLE RISK AND THAT THE SERVICE AND THE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” IN PARTICULAR, GOOGLE, ITS SUBSIDIARIES AND AFFILIATES, AND ITS LICENSORS AND THEIR SUPPLIERS, DO NOT REPRESENT OR WARRANT TO YOU THAT:
- THE SERVICE WILL MEET YOUR REQUIREMENTS;
- THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
- THE SERVICE WILL BE ACCURATE OR RELIABLE; AND
- DEFECTS IN THE OPERATION OR FUNCTIONALITY OF ANY SOFTWARE PROVIDED TO YOU AS PART OF THE SERVICE WILL BE CORRECTED.
14.3 ANY CONTENT OBTAINED THROUGH THE GOOGLE SERVICES IS AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER DEVICE, LOSS OF DATA, OR ANY OTHER DAMAGE OR INJURY THAT RESULTS FROM DOWNLOADING OR USING ANY SUCH CONTENT.
14.4 NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM GOOGLE, OR THROUGH OR FROM THE SERVICE OR CONTENT, WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.
14.5 GOOGLE, ITS LICENSORS, AND THEIR SUPPLIERS FURTHER EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
15. LIMITATIONS OF LIABILITY.
15.1 SUBJECT TO SECTION 14.1, YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOOGLE, ITS SUBSIDIARIES, AND AFFILIATES, AND GOOGLE’S LICENSORS AND THEIR SUPPLIERS, WILL NOT BE LIABLE TO YOU FOR:
- ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES THAT MAY BE INCURRED BY YOU, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY (INCLUDING CONTRACT, TORT, COMMON LAW, OR STATUTORY DAMAGES); ANY LOSS OF REVENUES OR PROFIT (WHETHER INCURRED DIRECTLY OR INDIRECTLY); ANY LOSS OF GOODWILL OR BUSINESS REPUTATION; ANY LOSS OF DATA; ANY COST TO PROCURE SUBSTITUTE GOODS OR SERVICES; OR ANY INTANGIBLE LOSS; OR
- ANY LOSS OR DAMAGE AS A RESULT OF:
- ANY RELIANCE PLACED BY YOU ON THE COMPLETENESS, ACCURACY, OR EXISTENCE OF ANY ADVERTISING, OR AS A RESULT OF ANY RELATIONSHIP OR TRANSACTION BETWEEN YOU AND ANY ADVERTISER OR SPONSOR WHOSE ADVERTISING APPEARS ON GOOGLE SERVICES;
- ANY CHANGES THAT GOOGLE MAY MAKE TO THE SERVICE, OR ANY PERMANENT OR TEMPORARY DISCONTINUATION OF THE SERVICE (OR ANY FEATURES WITHIN THE SERVICE);
- THE DELETION OR CORRUPTION OF, OR FAILURE TO STORE, ANY CONTENT AND OTHER DATA MAINTAINED OR TRANSMITTED BY OR THROUGH YOUR USE OF THE SERVICE;
- YOUR FAILURE TO PROVIDE GOOGLE WITH ACCURATE ACCOUNT INFORMATION; OR
- YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL.
15.2 THE LIMITATIONS ON GOOGLE’S LIABILITY IN SECTION 15.1 ABOVE WILL APPLY WHETHER OR NOT GOOGLE, ITS SUBSIDIARIES, AFFILIATES, LICENSORS OR THEIR SUPPLIERS HAVE BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES OR DAMAGES.
16. Indemnities.
16.1 You will defend and indemnify Google and its affiliates, directors, officers, employees, strategic partners, licensors, and their suppliers (the “Indemnified Parties“) against all liabilities, damages, losses, costs, fees (including legal fees), and expenses relating to any allegation or third-party legal proceeding to the extent arising from:
- your use of the Service or the Content in breach of the Terms or applicable policies;
- your Maps API Implementation, including any claim that your Maps API Implementation infringes a third party’s rights or violates applicable law; or
- Your Content.
16.2 You will cooperate as fully as reasonably required in the defense of any allegation or third-party legal proceeding. Google reserves the right, at its own expense, to assume the exclusive control and defense of any indemnified matter under this Section 16.
17. Copyright Policies; Content Removal; Termination of Repeat Offenders’ Accounts.
It is Google’s policy to respond to notices of alleged copyright infringement that comply with applicable international intellectual property law (including, in the United States, the Digital Millennium Copyright Act) and to terminate the accounts of repeat offenders. Details of Google’s policy can be found here.
18. Other Content.
18.1 The Service may include hyperlinks to other websites or content or resources. Google has no control over any websites or resources that are provided by companies or persons other than Google. You understand and agree that Google is not responsible for the availability of any such external sites or resources, and does not endorse any advertising, products, or other materials on, or available from, such websites or resources.
18.2 You understand and agree that Google is not liable for any loss or damage that you may incur as a result of the availability of those external sites or resources, or as a result of any reliance by you on the completeness, accuracy, or existence of any advertising, products, or other materials on, or available from, such websites or resources.
19. General Legal Terms.
19.1 Notices. Google may provide you with notices, including those regarding changes to the Terms, by email, regular mail, or postings on the Service.
19.2 Assignment. Google may assign any part of this agreement without written consent.
19.3 No Waiver. Google will not be treated as having waived any rights by not exercising (or delaying the exercise of) any rights under these Terms. A waiver will be effective only if Google expressly states in a writing signed by an authorized representative that Google is waiving a specified Term.
19.4 Third-Party Beneficiaries. Google’s affiliates and the Indemnified Parties are third-party beneficiaries to the Terms and are entitled to directly enforce, and rely on, any Terms that confer a right or benefit to them. There are no other third-party beneficiaries to the Terms.
19.5 Entire Agreement. These Terms set out all terms agreed between the parties and supersede all other agreements between the parties relating to its subject matter.
19.6 Severability. If any term (or part of a term) of these Terms is invalid, illegal or unenforceable, the rest of the Terms will remain in effect.
19.7 Equitable Relief. You understand and agree that damages for improper use of the Maps API(s) may be irreparable; therefore, Google is entitled to seek equitable relief, including injunctions in any jurisdiction, in addition to all other remedies it may have.
19.8 Conflicting Languages. If these Terms are translated into any other language, and there is a discrepancy between the English text and the translated text, the English text will govern.
19.9 Governing Law. ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR ANY RELATED GOOGLE SERVICES WILL BE GOVERNED BY CALIFORNIA LAW, EXCLUDING CALIFORNIA’S CONFLICT OF LAWS RULES, AND WILL BE LITIGATED EXCLUSIVELY IN THE FEDERAL OR STATE COURTS OF SANTA CLARA COUNTY, CALIFORNIA, USA; THE PARTIES CONSENT TO PERSONAL JURISDICTION IN THOSE COURTS.
My Privacy End User License Agreement
PLEASE READ THE FOLLOWING CAREFULLY BEFORE INSTALLING AND/OR USING THE APP.
By installing and/or using the MyPrivacy mobile software application (the “App”) you expressly acknowledge and agree that you are entering into a legal agreement with Online Permissions Technologies Ltd. (“Online Permissions”, “we”, “us” or “our”), and have understood and agree to comply with, and be legally bound by, the terms and conditions of this End User License Agreement (“Agreement”). You hereby waive any applicable rights to require an original (non-electronic) signature or delivery or retention of non-electronic records, to the extent not prohibited under applicable law. If you do not agree to be bound by this Agreement please do not download, install or use the App.
- Introduction. Our App allows you to create password protected access to mobile software application, pictures and other data on your Device (as defined below).
- Ability to Accept. By installing the App you affirm that you are over thirteen (13) years of age. If you are between the age of thirteen (13) and eighteen (18) years then, prior to installing the App, you must first review this Agreement with your parent or guardian to make sure that you and your parent or guardian understand its terms and conditions and agree to them.
- License. Subject to the terms and conditions of this Agreement, we hereby grant you a personal, revocable, non-exclusive, non-sublicensable, non-assignable, non-transferable license (“License”) to: (i) download, install and use the App on a mobile telephone, tablet or device (each a “Device”) that you own or control; and (ii) access and use the App on that Device in accordance with this Agreement and any applicable Usage Rules (defined below).
- License Restrictions. You agree not to, and shall not permit any third party to: (i) sublicense, redistribute, sell, lease, lend or rent the App; (ii) make the App available over a network where it could be used by multiple devices owned or operated by different people at the same time; (iii) disassemble, reverse engineer, decompile, decrypt, or attempt to derive the source code of, the App; (iv) copy (except for back-up purposes), modify, improve, or create derivative works of the App or any part thereof; (v) circumvent, disable or otherwise interfere with security-related features of the App or features that prevent or restrict use or copying of any content or that enforce limitations on use of the App; (vi) remove, alter or obscure any proprietary notice or identification, including copyright, trademark, patent or other notices, contained in or displayed on or via the App; (vii) use any communications systems provided by the App to send unauthorized and/or unsolicited commercial communications; (viii) use the Online Permissions name, logo or trademarks without our prior written consent; and/or (ix) use the App to violate any applicable laws, rules or regulations, or for any unlawful, harmful, irresponsible, or inappropriate purpose, or in any manner that breaches this Agreement.
- Usage Rules. If you are downloading the App from a third party mobile device platform or service provider (“Distributor”), please be aware that the Distributor may have established usage rules which also govern your use of the App (“Usage Rules”). We specifically refer to the Usage Rules of certain Distributors below in the section below entitled ‘Distributor Requirements and Usage Rules‘, but other Usage Rules may be applicable depending on where the App has been downloaded from. You acknowledge that, prior to downloading the App from a Distributor, you have had the opportunity to review and understand, and will comply with, its Usage Rules. The Usage Rules that are applicable to your use of the App are incorporated into this Agreement by this reference. You represent that you are not prohibited by any applicable Usage Rules and/or applicable law from using the App; if you are unable to make such a representation you are prohibited from installing and/or using the App.
- Intellectual Property Rights.

- Ownership. The App is licensed and not sold to you under this Agreement and you acknowledge that Online Permissions and its licensors retain all title, ownership rights and Intellectual Property Rights (defined below) in and to the App (and its related software). We reserve all rights not expressly granted herein to the App. “Intellectual Property Rights” means any and all rights in and to any and all trade secrets, patents, copyrights, service marks, trademarks, know-how, or similar intellectual property rights, as well as any and all moral rights, rights of privacy, publicity and similar rights of any type under the laws or regulations of any governmental, regulatory, or judicial authority, whether foreign or domestic.
- Content. The content on the App, including without limitation, the text, information, documents, descriptions, products, software, graphics, photos, sounds, videos, interactive features, and services (the “Materials”), and the trademarks, service marks and logos contained therein (“Marks”, and together with the Materials, the “Content”), is the property of Online Permissions and/or its licensors and may be protected by applicable copyright or other intellectual property laws and treaties. “Online Permissions Technologies”, “MyPrivacy” and the Online Permissions logo are Marks of Online Permissions and its affiliates. All other Marks used on the App are the trademarks, service marks, or logos of their respective owners.
- Use of Content. The content on the App is provided to you “as is” for your personal use only and may not be used, copied, distributed, transmitted, broadcast, displayed, sold, licensed, de-compiled, or otherwise exploited for any other purposes whatsoever without our prior written consent. If you download or print a copy of the content you must retain all copyright and other proprietary notices contained therein.

- Payments.

- The License granted hereunder is currently for free, however, we may in the future charge a fee for certain features and/or uses we do charge a fee for certain features, uses or in-app purchases. You will not be charged for any such uses of the App unless you first agree to such charges, but please be aware that any failure to pay applicable charges may result in you not having access to some or all of the App.
- Please be aware that your use of the App may require and utilize internet connection or data access. To the extent that third party service provider or carrier charges for your internet or data usage are applicable, you agree to be solely responsible for those charges.

- Information Description. We attempt to be as accurate as possible. However, we cannot and do not warrant that the content available on the App is accurate, complete, reliable, current, or error-free. We reserve the right to make changes in or to the content, or any part thereof without the requirement of giving you any notice prior to or after making such changes to the content.
- Privacy. We will use any personal information that we may collect or obtain in connection with the App in accordance with our privacy policy which is available at https://mypermissions.com/myprivacy-privacy-policy/ (“Privacy Policy”), and you agree that we may do so. Notwithstanding, you are aware that you are not legally obligated to provide us personal information, and you hereby confirm that providing us personal information is at your own free will. Please also be aware that certain personal information and other information provided by you in connection with your use of the App may be stored on your Device (even if we do not collect that information). You are solely responsible for maintaining the security of your Device from unauthorized access.

- THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND INCLUDING, WITHOUT LIMITATION, REPRESENTATIONS, WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR FROM A COURSE OF DEALING OR USAGE OF TRADE.
- WE DO NOT WARRANT THAT THE APP WILL OPERATE ERROR-FREE, THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL CODE OR THAT WE WILL CORRECT ANY ERRORS IN THE APP. YOU AGREE THAT WE WILL NOT BE HELD RESPONSIBLE FOR ANY CONSEQUENCES TO YOU OR ANY THIRD PARTY THAT MAY RESULT FROM TECHNICAL PROBLEMS INCLUDING WITHOUT LIMITATION IN CONNECTION WITH THE INTERNET (SUCH AS SLOW CONNECTIONS, TRAFFIC CONGESTION OR OVERLOAD OF OUR OR OTHER SERVERS) OR ANY TELECOMMUNICATIONS OR INTERNET PROVIDERS.
- THE APP IS A BETA VERSION AND THEREFORE NOT ALL FEATURES MAY BE FULLY IMPLEMENTED OR REFINED. THIS BETA VERSION MAY NOT REPRESENT THE FINAL PRODUCT AND MAY CONTAIN BUGS, ERRORS AND OTHER PROBLEMS. YOUR USE OF THE APP IS AT YOUR OWN RISK TAKING INTO THE FACT THAT YOU ARE AWARE THAT THIS IS A BETA VERSION APP. THESE TERMS DO NOT INCLUDE THE RIGHT TO ANY FUTURE VERSIONS OF THE APP, INCLUDING FINAL AND NON BETA VERSIONS, AND/OR ANY REVISIONS, UPDATES, UPGRADES OR NEW RELEASE. THERE MAY BE UNRESOLVED BUGS, INTERRUPTIONS AND OTHER FAILURES AND ERRORS IN THE PERFORMANCE AND OPERATION OF THE APP AND WE MAY NOT OFFER TECHNICAL SUPPORT FOR THESE ISSUES.
- IF YOU HAVE A DISPUTE WITH ANY OTHER APP USER, YOU AGREE THAT WE ARE NOT LIABLE FOR ANY CLAIMS OR DAMAGES ARISING OUT OF OR CONNECTED WITH SUCH A DISPUTE. WE RESERVE THE RIGHT, BUT HAVE NO OBLIGATION, TO MONITOR ANY SUCH DISPUTE.
- Applicable law may not allow the exclusion of certain warranties, so to that extent such exclusions may not apply.

- Limitation of Liability.

- UNDER NO CIRCUMSTANCES SHALL Online Permissions BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, BUSINESS OR REPUTATION, THAT ARISES UNDER OR IN CONNECTION WITH THIS AGREEMENT, OR THAT RESULTS FROM THE USE OF, OR THE INABILITY TO USE, THE APP EVEN IF ONLINE PERMISSIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- IN ANY EVENT, ONLINE PERMISSIONS’ TOTAL AGGREGATE LIABILITY FOR ALL DAMAGES AND LOSSES THAT ARISE UNDER OR IN CONNECTION WITH THIS AGREEMENT, OR THAT RESULT FROM YOUR USE OF OR INABILITY TO USE THE APP, SHALL NOT IN ANY CIRCUMSTANCE EXCEED THE TOTAL AMOUNTS, IF ANY, ACTUALLY PAID BY YOU TO ONLINE PERMISSIONS FOR USING THE APP WITHIN THE THREE (3) MONTHS PRECEDING THE DATE OF BRINGING A CLAIM.

- Indemnity. You agree to defend, indemnify and hold harmless Online Permissions and our affiliates, and our respective officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to attorney’s fees) arising from: (i) your use of, or inability to use, the App; (ii) your violation of this Agreement; and (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right. Without derogating from or excusing your obligations under this section, we reserve the right (at your own expense), but are not under any obligation, to assume the exclusive defense and control of any matter which is subject to an indemnification by you if you choose not to defend or settle it. You agree not to settle any matter subject to an indemnification by you without first obtaining our express approval.
- Export Laws. You agree to comply fully with all applicable export laws and regulations to ensure that neither the App nor any technical data related thereto are exported or re-exported directly or indirectly in violation of, or used for any purposes prohibited by, such laws and regulations.
- Updates and Upgrades. We may from time to time provide updates or upgrades to the App (each a “Revision”), but are not under any obligation to do so. Such Revisions will be supplied according to our then-current policies, which may include automatic updating or upgrading without any additional notice to you. You consent to any such automatic updating or upgrading of the App. All references herein to the App shall include Revisions. This Agreement shall govern any Revisions that replace or supplement the original App, unless the Revision is accompanied by a separate license agreement which will govern the Revision.
- Term and Termination.

- This Agreement is effective until terminated by us or you. We reserve the right, at any time, to: (i) discontinue or modify any aspect of the App; and/or (ii) terminate this Agreement and your use of the App with or without cause, and shall not be liable to you or any third party for any of the foregoing. If you object to any term or condition of this Agreement or any subsequent modifications thereto, or become dissatisfied with the App in any way, your only recourse is to immediately discontinue use of the App.
- Upon termination of this Agreement, you shall cease all use of the App. This Section 15.2 and Sections, 6 (Intellectual Property Rights), 9 (Privacy), 10 (Warranty Disclaimers), 11 (Limitation of Liability), 12 (Indemnity), and 16 (Assignment) to 19 (General) shall survive termination of this Agreement.

- Assignment. This Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you but may be assigned by Online Permissions without restriction or notification.
- Modification. We reserve the right to modify this Agreement at any time by sending you an in-App notification and/or publishing the revised Agreement on the App. Such change will be effective ten (10) days following the foregoing notification thereof, and your continued use of the App thereafter means that you accept those changes.
- Governing Law and Disputes. This Agreement shall be governed by and construed in accordance with the laws of the State of Israel without regard to its conflict of laws rules. You agree to submit to the personal and exclusive jurisdiction of the courts located in Tel Aviv-Jaffa, and waive any jurisdictional, venue, or inconvenient forum objections to such courts. Notwithstanding the foregoing, we may seek injunctive relief in any court of competent jurisdiction.
- General. This Agreement, and any other legal notices published by us in connection with the App, shall constitute the entire agreement between you and Online Permissions concerning the App. In the event of a conflict between this Agreement and any such legal notices, the terms of the applicable notice shall prevail with respect to the subject matter of such notice. No amendment to this Agreement will be binding unless in writing and signed by Online Permissions. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and a party’s failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision. YOU AGREE THAT ANY CAUSE OF ACTION THAT YOU MAY HAVE ARISING OUT OF OR RELATED TO THE APP MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
- Third Party Open Source Software. Portions of the App may include third party open source software that are subject to third party terms and conditions (“Third Party Terms”). A list of any third party open source software and related Third Party Terms is available at https://mypermissions.com/myprivacy-open-source-compliance/. If there is a conflict between any Third Party Terms and the terms of this Agreement, then the Third Party Terms shall prevail but solely in connection with the related third party open source software.
- Distributor Requirements and Usage Rules.

- Apple. If you download the App from the Apple, Inc. (“Apple”) App Store (or in any event if you download an Apple iOS App) then, without derogating from the warranty disclaimers and limitation of liability as set forth in the Agreement:
- You acknowledge and agree that:
- this Agreement is concluded between Online Permissions and you only, and not with Apple, and Online Permissions and its licensors, and not Apple, are solely responsible for the App and the content thereof. Your use of the App is also subject to the Usage Rules established by Apple, including those set forth in the Apple App Store Terms of Service, effective as of the date that you enter into this Agreement. The License granted herein is limited to a non-transferable right to use the App on an Apple iPhone, iPod Touch, iPad, or other Apple-branded product that you own or control and that runs the iOS; Online Permissions is solely responsible for providing any maintenance and support services with respect to the App, as specified in this Agreement, or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App; Online Permissions is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will, to the extent applicable, refund any purchase price paid (if any) by you for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and, any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Online Permissions’ sole responsibility; Online Permissions, and not Apple, is responsible for addressing any product claims you, or any third party, may have relating to the App or your possession and/or use of the App, including, but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation, including in connection with the App’s use of HealthKit and HomeKit frameworks;
- in the event of any third party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Apple shall not be responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim;
- Apple, and its subsidiaries, are third party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third party beneficiary thereof.
- You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

- By entering into this Agreement you, to the extent legally permitted, hereby waive any applicable law requiring that this Agreement be localized to meet your language and other local requirements. Privacy Policy
This is the privacy policy (“Privacy Policy”) that governs how we, Online Permissions Technologies Ltd. (“Online Permissions”, “we”, “our” or “us”), use Personal Information (defined below) that we collect, receive and store about individuals in connection with the use of the MyPrivacy mobile software (“App”).
- Introduction. We have implemented this Privacy Policy because your privacy, and the privacy of other users, is important to us. This Privacy Policy explains our online information practices and the choices you can make about the way your Personal Information is collected and used in connection with the App. “Personal Information” means any information that may be used, either alone or in combination with other information, to personally identify an individual, including, but not limited to, a first and last name, a personal profile, an email address, a home or other physical address, or other contact information.
- EULA. This Privacy Policy forms part of our App’s End User License Agreement which can be viewed from within the App and which you accepted prior to downloading, installing and/or using the App for the first time (“EULA”). Any capitalized but undefined term in this Privacy Policy shall have the meaning given to it in the Terms.
- Consent and Modification. You are not legally obligated to provide us Personal Information, and you hereby confirm that providing us Personal Information is at your own free will. By using the App, you consent to the terms of this Privacy Policy and to our collection, processing and sharing of Personal Information for the purposes set forth herein. If you do not agree to this Privacy Policy, please do not access or otherwise use the App. We reserve the right, at our discretion, to change this Privacy Policy at any time. Such change will be effective ten (10) days following posting of the revised Privacy Policy in the App, and your continued use of the App thereafter means that you accept those changes.
- What Personal Information We Collect and How We Collect It. We receive and/or collect Personal Information from you in the following ways:

- Password Recovery. Our App allows you to create password protected access to mobile software application, pictures and other data on your mobile device. In order to create password protection as aforementioned, you will be asked to create a password in connection with the application and data you choose to protect via the App (“Password”). If you wish to have to option to recover your Password, you will be required to provide us with your current Password and your email address.
- ‘Contact Us’ Information. If you send us a “Contact Us” request, whether by submitting an online form that we make available or by sending an email to an email address that we display, you may be required to provide us with certain information such as your name, email address, userId, userName, application version, Device model, android version of the Device.
- Log Files. We may make use of log files. The information inside the log files includes internet protocol (IP) addresses, type of browser and date/time stamp,. We may use such information to analyze trends, administer the App, track user’s movement around the App.
- Mobile Device Data. We may collect limited information from your mobile device in order to provide the App. Such information may include your mobile device type, mobile device id, and date and time stamps of App use. In addition, we may deploy tracking technologies within the App to help us gather aggregate statistics, but we will not use Personal Information for such purposes.
- Analytics Tool. Our App may use the tools described below (the “Analytics Services”) to collect information about use of our App, such as how often users visit our App, what pages they visit when they do so, and what other sites they used prior to visiting our App. We use the information we collect from the Analytics Services to maintain and improve our App and our products and services.

- Google Analytics. We do not combine the information collected through the use of Google Analytics with Personal Information. Google’s ability to use and share information collected by Google Analytics about your visits to and use of our App is restricted by the Google Analytics Terms of Service, available at http://www.google.com/analytics/terms/us.html, and the Google Privacy Policy, available at http://www.google.com/policies/privacy/. You may learn more about how Google collects and processes data specifically in connection with Google Analytics at http://www.google.com/policies/privacy/partners/. - Mixpanel. Mixpanel’s ability to use and share information collected by Mixpanel about your visits to and use of the App is restricted by Mixpanel’s Terms of Use, available at https://mixpanel.com/terms/, and Mixpanel’s Privacy Policy, available at https://mixpanel.com/privacy/. - We will use your Personal Information to provide and improve our App, to send you marketing/advertisement communications that we believe may be of interest to you, to contact you in connection with the App and certain programs or offerings that you may have registered for, and to identify and authenticate your access to the parts of the App that you are authorized to access.
- We may use your designated email address to: (i) send you updates or news regarding the App and our products; and/or (ii) respond to a “Contact Us” or administrative request (for example, to change and/or recover your Password).
- We may transfer your Personal Information to our local or foreign subsidiaries for the purpose of storing or processing such information on our behalf. Such information may be transferred to other countries. We require that these parties agree to process such information in compliance with our Privacy Policy.
- We may share your Personal Information with our third party service providers and partners, but only to assist us with our business operations and to provide our App to you and other users. Such information may be transferred to other countries. We use commercially reasonable efforts to only engage or interact with third party service providers and partners that post a privacy policy governing their processing of Personal Information.
- We may disclose your Personal Information or any information you submitted via the App if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our EULA, including investigations of potential violations thereof; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property or safety of Online Permissions, our users, yourself or the public.

- Use of Anonymous Information. We may use Anonymous Information (as defined below) or disclose it to third party service providers in order to improve our App and enhance your experience with the App. We may also disclose Anonymous Information (with or without compensation) to third parties, including partners. “Anonymous Information” means information which does not enable identification of an individual user, such as aggregated information about the use of our App.
- Opting Out. You may choose not to receive future promotional, advertising, or other App-related emails from us by selecting an unsubscribe link at the bottom of each email that we send. Please note that even if you opt out of receiving the foregoing emails, we may still send you a response to any “Contact Us” request as well as administrative emails (for example, in connection with a Password reset request) that are necessary to facilitate your use of the App.
- Choice. At all times, you may choose whether or not to provide or disclose Personal Information. If you choose not to provide mandatory Personal Information, you may still visit parts of the App but you may be unable to access certain options, programs, offers, and services that involve our interaction with you.
- Access/Accuracy. To the extent that you do provide us with Personal Information, we wish to maintain accurate Personal Information. If you would like to delete or correct any of your other Personal Information that we may be storing, you may use the tools that we make available on the App or you may submit an access request by sending an email to feedback@mypermissions.com. Your email should include adequate details of your request.
- Links to and Interaction with Third Party Products. The App may enable you to interact with or contain links to third party websites, mobile software applications and services that are not owned or controlled by us (each a “Third Party Service”). We are not responsible for the privacy practices or the content of these Third Party Services. Please be aware that the Third Party Services may collect Personal Information from you. Accordingly, we encourage you to read the terms and conditions and privacy policy of each Third Party Service that you choose to use or interact with.
- Children’s Privacy. The App is not structured to attract children under the age of 13 years. Accordingly, we do not intend to collect Personal Information from anyone we know to be under 13 years. If we learn that we have collected Personal Information from a child under 13 years, we will delete that information as quickly as possible. - Security. The security of Personal Information is important to us. We follow generally accepted industry standards, including the use of appropriate administrative, physical and technical safeguards, to protect the Personal Information submitted to us. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use reasonable acceptable means to protect your Personal Information, we cannot guarantee its absolute security or confidentiality. - Merger, Sale or Bankruptcy. In the event that we are acquired by or merged with a third party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer or assign Personal Information in connection with the foregoing events.
- California Privacy Rights. California Civil Code Section 1798.83 permits our customers who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an email to feedback@mypermissions.com. Please note that we are only required to respond to one request per customer each year.
- Our California Do Not Track Notice. We do not currently respond or take any action with respect to web browser “do not track” signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personally identifiable information about an individual consumer’s online activities over time and across third-party web sites or online services. We may allow third parties, such as companies that provide us with analytics tools, to collect personally identifiable information about an individual consumer’s online activities over time and across different web sites when a consumer uses the App.
- Deletion of Content from California Residents. If you are a California resident under the age of 18 and a registered user, California Business and Professions Code Section 22581 permits you to remove content or Personal Information you have publicly posted. If you wish to remove such content or Personal Information and you specify which content or Personal Information you wish to be removed, we will do so in accordance with applicable law. Please be aware that after removal you will not be able to restore removed content. In addition, such removal does not ensure complete or comprehensive removal of the content or Personal Information you have posted and that there may be circumstances in which the law does not require us to enable removal of content.
- Commitment. We are committed to protecting your privacy. Protecting your privacy online is an evolving area, and we are constantly evolving our App to meet these demands. Do you collect or use my data in any way?
No, we do not. We do not collect, or use, your data in any way. We believe your private data is yours and we have no interest whatsoever in using your data.
Do you share or sell my data to any 3rd party?
No! Absolutely not. We do not sell, share, or make your personal information available in any other way to anyone.
How do you make money?
While some of the products in MyPrivacy are free to use, other products will only be offered to premium subscribers. In this day and age, if you are not the customer, you are the product. Free websites, apps, and services usually adopt business models that place them in a conflict of interest with their customers and users. Not us. We believe in a transparent transaction – the only thing we sell is our product to you, our customers. Nothing else.
Why do I need to enter a recovery email?
MyPrivacy requires setting up a key – like pattern-based code, PIN code, or fingerprint – in order to protect your private information. In case you forget this key, there is no way for us to help you recover your key unless you set up a recovery email.
What is your relationship with MyPermissions?
MyPermissions Privacy Cleaner was the first product we developed and offered to the public. Based on lessons learned from Privacy Cleaner, we decided to build MyPrivacy. MyPrivacy is the culmination of many ideas, insights, and implementations of those lessons in a single mobile app. It’s the same trusted and beloved company, with a new product.
Is MyPrivacy for me? Do I have to be a privacy expert to use it?
MyPrivacy is for everyone, no matter how tech literate. No matter if you are an expert in handling modern technology or can hardly operate a TV remote control, MyPrivacy was designed to help regular people maintain their privacy in an easy way.
How do I recover my password?
Recovering your password can only be done if you have already set a recovery email before. If MyPrivacy will notice you have trouble logging into your account, it will suggest sending a recovery email to help you regain access to your personal information.
Can I recover my password if I didn’t enter a recovery email?
No, we’re afraid not. In order to protect the privacy of our users and customers, you cannot recover your password if you haven’t set a recovery email first. Otherwise, it means potentially malicious parties may exploit this recovery flow to get access to your most sensitive and private secrets.
I locked myself out of the app and I haven’t set a recovery email, can you help?
Unfortunately, no. The recovery mechanism was designed in this way to respect the privacy and security of our users’ data and privacy.
How are you any different than other apps?
Many of the apps you can find on Google Play and App Store are either very easy to use or very respectful of your privacy. Hardly never these apps do both. The apparently-friendly apps have conflicting interests with their users, and usually, end up collecting and likely selling their users data to advertisers, hackers, or other potentially harming parties. On the other hand, apps that respect the privacy of their users are usually designed for expert and aren’t as easy to use. They were not designed to be used by the common user. The few apps that do both – respect privacy and designed to be easy to use – do not offer a complete set of tools to protect your digital privacy.

Ask yourself “When was the last time I took a vacation?”. For most of us, it has been a few months if not a few years. Wouldn’t it be great to go away with your family and friends? Traveling is great. The mixture of exploring new places and getting to spend quality time with family and friends allows you to make beautiful memories that could last a lifetime.
Deciding where to go and what activities to do is a hassle, but it will ultimately be worth it for the sake of getting away from the day to day routine. However, we all know the undisputable worst part about traveling. The one thing that inhibits plans from happening:
Booking the damn flight ticket and hotel room.
Every website seems to have a different price for the same flights and hotels. The prices appear to go up and down by day and depending on where you are. The worst part is that someone always ends up with a better price. It all makes for a miserable planning experience for everyone involved.
Why can’t everyone just get the same ticket and hotel price? Why are there multiple price options for similar hotel rooms and the same kind of tickets on the same flight or airline?
The answer is pretty simple, it is called dynamic pricing, and the travel industry has been using it for over a decade.
What is dynamic pricing?
Dynamic pricing is a strategy in which businesses change the prices of their products based on various factors that affect market demand to maximize a company’s (or firm’s) profit. Many businesses can have dynamic prices because of algorithms that take these different factors into account based on supply and demand. These algorithms can target specific users and profile them based on the data that they track from you such as your location, time of day, and device you are using.
In its most extreme form, dynamic pricing based on profiling leverages data points extracted from the user’s data to maximize the cost of an item. This concept of maximizing profits is known in economics as price discrimination, more specifically third-degree price discrimination.
As the name suggests, this is a form of discrimination. As Ari Shpanya – the CEO of Wiser, a Dynamic Pricing Search Engine – states in a Quora answer:
“Third degree price discrimination takes it one step further by using that data to change pricing based on where a shopper is located, how much they’ve spent previously, and other behavioral indicators. The point is to maximize revenue and/or profits.”

Static pricing vs. Dynamic pricing
Despite the fact that you are profiled, dynamic pricing is still legal, unless it is based upon certain factors. According to a 2015 blog post on FindLaw.com, “Price discrimination is illegal if it is based on impermissible factors like race, gender, religion, or nationality. So stores can’t charge men and women different prices for the same product.” That means dynamic pricing can still be based on your location, the time of day, what device you’re using, and your browsing history.
Let’s consider a few examples:
E-commerce platforms and retailers can assume that a person using their platform on a Mac can pay more money for their product or service than someone using a PC.
Why? A Mac is more expensive than a PC, so a Mac user could be open to spending more on their product.
The same logic goes for location. A person in Beverly Hills, CA would be willing to pay more and has more money to spend for a service than someone in North Dakota because Beverly Hills has a higher cost of living.
A similar logic can be applied to the time of purchase. Someone purchasing an airplane ticket two weeks before the departure will pay more for the ticket than someone who is booking the ticket two months in advance because of urgency and need; thus airlines will change prices.
Travel and hospitality industry
The travel industry takes advantages of the scarcity of their products and will try to get the most money from the people that are willing to pay the most. The examples are numerous.
In 2012, Orbitz – a travel search engine – found that Mac users were willing to pay 30 percent more for a hotel than Windows users, and they effectively were able to steer more affluent customers to pricier hotels, as per a Wall Street Journal article.
Also in 2012, Time reported that the airline charged frequent flyers up to $300 more for a ticket because people who travel often are probably doing it out of necessity – for business purposes, most likely. These people are willing to pay more to get to where they need to go and are engulfed in a program that disincentives finding an ideal price for the sake of gaining “miles” or “points.”
A 2014 article in the Boston Globe on the hotel industry about their dynamic pricing models shows that travel companies intentionally offer users prices based on factors such as previous purchases and clicks or what kind of device they were using. The study done by Northeastern compared a Desktop PC running Internet Explorer and a laptop PC running Firefox with an iPhone running Safari. The results showed that each travel website had different prices to show, proving that dynamic pricing is used to maximize profit:

Work around profiling based dynamic pricing
Fortunately, there are many things one can do to jump over the hurdle of dynamic pricing.
Clear your cookies
As whatarecookies.com states, “Cookies are small files which are stored on a user’s computer. They are designed to hold a modest amount of data specific to a particular client and website, and can be accessed either by the web server or the client computer.”
Essentially, they are data that websites get about you, such as where you’ve been and what you’ve done.
If you clear the cookies off your browser, you are giving dynamic pricing algorithms less information to work with, and that can ultimately be better for you.

Browsing in incognito mode
A great way to avoid dynamic pricing is if you use your browser’s private mode. This is because in incognito mode your computer does not track your browser’s history or cookies. So websites cannot change your prices based off of browsing or buying history.

Switch your User Agent
As we learned, some companies inflate prices to certain consumers based on what device they are using. A user agent is software that is acting on behalf of a user. In this context, a web browser often informs websites visited about the browser and operating system used.
Does this mean you have to switch computers and browsers? No.
There are many ways to switch user agents from within your current browser. For example, useragentswitcher.org has browser extensions that are supported by Chrome, Firefox, and Opera. You can learn how to switch your user agent on Safari here.
Use a VPN to change your location
A virtual private network (VPN) is a network that is constructed using public wires — usually the Internet — to connect to a private network. In this context, you can use a VPN to change where websites think your location is. You can hide who you are and where you are from.
For example, I am currently in Tel Aviv but I can use a VPN to connect me to a private network in New York. This will make websites think that I am in New York.
What have we learned about dynamic pricing?
- Dynamic pricing is the concept of fluctuating prices to get the most profit out of consumers. Regardless of the industry, companies use the many data that you give them to maximize the amount of money they get from you.
- The travel industry is notoriously guilty of dynamic pricing based on profiling – also known as price discrimination.
- There are ways to get around dynamic pricing: blocking location services, browsing in incognito mode, switching user, clearing cookies, and using a VPN.
